Terms and Conditions
Last updated: 29 October 2026
These Terms and Conditions ("Terms") are a contract between you and Munthu ("we", "us", "our"), the operator of the Munthu platform, based at Area 24, Sector 1, Lilongwe, Malawi. They govern your access to and use of Munthu websites, accounts, workspaces, and related services (together, the "Service").
By creating an account, ticking the agreement box at signup, or continuing to use the Service after these Terms are shown to you, you agree to these Terms and to our Privacy Policy. If you do not agree, do not create an account and do not use the Service.
These Terms are the rules for using Munthu. They are not a substitute for advice from a lawyer about your own business.
Who may use Munthu
You may create an account only if all of the following are true:
- You are at least 18 years old, or you have reached the age of majority where you live if that age is higher than 18.
- You are able to enter a binding contract.
- You are not barred from using the Service under the laws of Malawi or the laws that apply to you.
- If you sign up for an organisation, you have authority to bind that organisation, and "you" includes that organisation.
You must give your real name and a working email address, Malawi mobile number, or both. You may also sign in with Google. You are responsible for keeping those sign-in methods under your control.
The Service
Munthu is an identity and workspace platform. With an account you can:
- Keep a personal profile and sign in across Munthu.
- Open a personal workspace, and create or join organisation workspaces ("portfolios").
- Turn on applications we make available to a workspace, such as people, operations, or other products listed in your workspace.
- Invite other people into a workspace and assign roles.
- Receive codes, links, and notices by email or SMS so you can finish signup, sign in, or reset access.
- Use optional security tools, including a password and two-step verification.
We may add, change, or retire features. Connected applications may have their own screens, data, and, where we say so, their own terms. If an application's terms conflict with these Terms on a point that is only about that application, the application's terms apply to that point. These Terms still apply to your Munthu account, identity, and workspace membership.
Your account
Keep your password, one-time codes, and devices private. Tell us promptly at munthu.space@gmail.com if you believe someone else is using your account.
You are responsible for activity under your account, including activity by people you invite and activity in workspaces you administer, except where that activity is caused by our failure to secure the Service.
We may refuse a signup, require extra checks, or ask you to confirm that an email address or phone number is yours. One person should not keep more than one Munthu account to evade a limit, suspension, or these Terms.
Signing in with Google lets Google share with us the profile details needed to create or match your account, such as your name, email address, and profile photo. Google's own terms govern your use of Google. You can still set a Munthu password after signup.
Acceptable use
You agree not to:
- Break the law, including the laws of Malawi, or infringe someone else's rights.
- Upload or share content that is unlawful, fraudulent, defamatory, hateful, or that sexually exploits a child.
- Attempt to access an account, workspace, or application you are not allowed to use.
- Probe, scan, or test the vulnerability of the Service, or bypass security, rate limits, or access controls, except where we have agreed in writing to a security test.
- Interfere with the Service, including by sending malware, overloading systems, or scraping in a way that degrades the Service for others.
- Use the Service to send spam or unsolicited marketing.
- Misrepresent who you are, including by impersonating another person or organisation.
- Use another person's personal data in the Service without a lawful basis.
- Resell or sublicense the Service except through workspace invitations and features we provide.
We may investigate misuse and remove content, suspend access, or close an account where we reasonably believe these Terms have been broken or that the Service, other people, or us are at risk.
Workspaces, roles, and connected apps
A workspace owner or admin controls who is invited, which roles they have, and which applications are turned on. If you join a workspace, that organisation's administrators can see the membership and activity that the role and application expose to them.
When you enable an application for a workspace, you instruct us to make the relevant account and workspace data available to that application so it can run. You are responsible for deciding which applications to enable and for the instructions you give to people in your workspace.
We do not control how an independent organisation uses data inside its own workspace. Disputes between workspace members are primarily between those members. We may suspend a workspace that we reasonably believe is being used unlawfully or in breach of these Terms.
Your content and data
You keep ownership of the information, files, and other material you submit ("Your Content"). You grant us a non-exclusive licence to host, store, reproduce, and display Your Content only so we can operate, secure, and improve the Service, provide the applications you enable, and meet legal duties. This licence ends when Your Content is deleted from the Service, except for copies we must keep for security, dispute resolution, or law, and except for copies in routine backups until those backups expire.
You confirm that you have the rights needed to submit Your Content and to grant this licence.
Our Privacy Policy explains how we handle personal data. These Terms and that policy should be read together. Where they conflict about privacy, the Privacy Policy applies.
Messages and notices
We send service messages that are part of running your account, including signup links, one-time codes, security alerts, and billing notices. These are not optional while you keep an account, because the Service cannot work without them.
SMS is sent to the Malawi mobile number you give us. Your network may charge you for receiving messages. Email is sent to the address you give us. Keep both current.
Fees
Some features are free. Where a feature is paid, we show the price, billing period, and what you are buying before you pay. Taxes may apply.
You authorise us and our payment partners to charge the payment method you provide for the fees you accept. If a payment fails, we may suspend the paid part of the Service until it is settled. Fees already due remain payable. Unless a specific offer says otherwise, fees are not refundable once the paid period has started, except where the law requires a refund.
We may change prices for a future billing period. We will tell you before the new price applies. If you do not agree, cancel the paid feature before the next period starts.
Our intellectual property
Munthu, the Munthu name and logos, and the software, design, and documentation of the Service are owned by us or our licensors. These Terms do not give you any ownership of them.
We grant you a limited, revocable, non-exclusive licence to use the Service for your own personal or internal business purposes, in line with these Terms. You may not copy, modify, or reverse engineer the Service except where the law does not allow us to forbid it.
If you send us ideas or feedback, we may use them without payment or duty to you.
Availability and changes
We work to keep the Service available, but we do not promise that it will be uninterrupted, error-free, or fit for a purpose you have not agreed with us in writing. Maintenance, third-party outages, network failures, and events outside our reasonable control may interrupt the Service.
We may change the Service or these Terms. If we change these Terms in a way that materially reduces your rights, we will post the updated Terms and change the "Last updated" date, and where we have your email we will send a notice. The new Terms apply from the date we state. If you keep using the Service after that date, you accept the new Terms. If you do not agree, stop using the Service and close your account. Your account record stores the version of these Terms you accepted at signup.
Suspension and closing an account
You may stop using the Service at any time. Where the product provides account deletion, you may delete your account there. Deletion removes or anonymises personal data as described in the Privacy Policy, except for records we must keep by law, for security, or to resolve a dispute.
We may suspend or close your account, or disable a workspace or application, if:
- you break these Terms or we reasonably believe you are about to;
- we must do so to comply with law or a lawful request;
- your use creates a security or legal risk for us or for other people; or
- a paid feature remains unpaid after we have notified you.
Where it is reasonable and lawful to do so, we will tell you the reason and give you a chance to fix the issue before closure. We may act without advance notice where delay would increase harm.
Disclaimers
Except where Malawi law does not allow a disclaimer, the Service is provided "as is" and "as available". We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent those warranties can be disclaimed.
Information in the Service, including in connected applications, is for operating your account and workspace. It is not legal, tax, medical, or financial advice.
Liability
Nothing in these Terms excludes or limits liability that Malawi law does not allow us to exclude or limit, including liability for fraud, or for death or personal injury caused by negligence.
Subject to that, and to the extent the law allows:
- We are not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profits, revenue, goodwill, or data, whether or not we were advised it was possible.
- Our total liability arising out of the Service or these Terms in any 12-month period is limited to the greater of (a) the fees you paid us for the Service in that period, or (b) MWK 50,000 if you paid no fees.
You are responsible for keeping your own copies of Your Content. We are not liable for loss of content where you did not keep a copy and the loss was not caused by our failure to take reasonable care.
Your responsibility to us
You will indemnify us against claims, losses, and reasonable legal costs brought by a third party arising from Your Content, your workspaces, or your breach of these Terms, except to the extent the claim is caused by our breach of these Terms or our negligence.
Other services
The Service may link to or rely on other companies, including Google for sign-in, mobile networks for SMS, email delivery providers, and payment partners. Their services are their own. We are not responsible for their outages or for terms they apply to you, except for our own duty to choose and supervise processors of personal data as described in the Privacy Policy.
Governing law
These Terms are governed by the laws of the Republic of Malawi. The courts of Malawi have exclusive jurisdiction over disputes arising out of these Terms or the Service, except that we may also seek urgent relief in a court that can act quickly to protect the Service or our rights.
If a part of these Terms is held invalid, the rest stays in force. If we do not enforce a right immediately, we may still enforce it later. These Terms are the entire agreement between you and us about the Service and replace earlier oral or written terms about the same subject. You may not assign your account without our consent. We may assign these Terms to a successor that continues the Service, and we will tell you if that happens.
